Short-term legal consultancy: Mexico

Purpose of the contract

Open Ownership seeks an experienced, short-term contractor, either an organisation or independent consultant, to support the potential implementation of a centralised beneficial ownership registry in Mexico, including review of the quality of the available data and how access based on legitimate interest can in practice be used to deliver both the access to all parties who have a role to play in using data (either for tackling corruption and money laundering or for broader policy aims), as well as the type of access to ensure the data is most useful, while simultaneously balancing privacy with public interest.

The purpose of the contract is to review the existing legal frameworks pertaining to beneficial ownership and beneficial ownership data; identify gaps in the legislative framework, associated regulations, statutory instruments; and provide concrete recommendations for drafting a beneficial ownership register bill, or introducing amendments to existing laws, or to strengthen beneficial ownership data, interoperability and usability. This will also involve directly working with the Executive Secretariat of the National Anti-Corruption System (SESNA) and other national partners to understand the administrative context and technical systems through which such legislation and data interoperability could be implemented.

Brief details

The contractor will be responsible for providing a detailed overview of the relevant legislative and policy frameworks which could guide beneficial ownership registry implementation, disclosure, and data use in Mexico through the National Digital Platform. The successful contractor will need to demonstrate experience in related assignments, demonstrated through a history of experience of undertaking similar projects.

As this position is in support of implementation in Mexico, the contractor will need to be based within or in close proximity to Mexico City, and available to travel when required. We anticipate this opportunity involving an estimated 60 working days between 20 September 2024 and 18 December 2024.
